WACO, Texas (KWTX) – A McLennan County Sheriff’s Office deputy who was placed on administrative leave in February because of questions surrounding his arrest in a major drug case has been cleared by an internal investigation and returned to work this week.

Sheriff’s Office Chief Deputy Cody Blossman said an internal complaint against Deputy Derrick Shaw “was not sustained by our internal investigation,” which he said resulted in Shaw returning to work as a patrol deputy on Monday.

The McLennan County District Attorney’s Office dismissed two first-degree felony drug delivery charges against Bryan Christopher Parr, of Marlin, on the eve of Parr’s trial in February after discovering inconsistencies in Shaw’s sworn statement in a probable cause arrest affidavit and video evidence from the traffic stop.

As prosecutors Kristi DeCluitt and Chris Spendlove were preparing Parr’s case for trial, they discovered dashcam video from Shaw’s patrol car did not match his sworn statement in arrest affidavits that he had probable cause to pull Parr over because of “defective equipment.”

In arrest reports and in dashcam recordings the night of July 19, 2024, Shaw reported Parr’s license plate light was not working and that’s why he pulled him over in the 200 block of Hallsburg Road.

The video, which the prosecutors provided to defense attorney Bryan Cantrell, shows the back of Parr’s car with the license plate light shining brightly along with other lights on the back of the car.

Cantrell also spotted the discrepancy and was prepared to offer that evidence at trial. He told KWTX in February the prosecutors were correct to dismiss the case.

“It goes to their integrity,” Cantrell said after the case was dismissed. “I didn’t have to tell them. Kristi came to me and said, ‘Look, I’m not putting a liar on the stand.’ Knowing Kristi and Chris the way I do, their integrity will not allow them to use an officer as a witness if they thought he had lied for an arrest.”

Parr was released from the McLennan County Jail Saturday after spending about seven months in jail. He faced up to life in prison at trial.

Blossman said Wednesday he is “going to defer to the judgment of the DA’s office” when asked about the case being dismissed.

Shaw reported he searched the car and found a black backpack in the back seat that contained 6.6 grams of methamphetamine, 36.7 grams of ecstasy, 7.6 grams of cocaine, 0.6 of a gram of crack cocaine, 11 THC vapes and six packages of THC gummies.

McLennan County District Attorney Josh Tetens said his office did the right thing by dismissing the case.

“Regarding the dismissal of a case (Shaw) was involved in, we stand by our decision to dismiss based on a suppression issue surrounding the video evidence of the stop,” Tetens said. “For future cases involving Deputy Shaw, we will review them with that same level of scrutiny as we do other cases, with the same goal in mind to seek justice and not just convictions. We appreciate the diligent work of the Sheriff’s Office to ensure this matter was resolved timely, and we look forward to continuing working with all of them to keep our community safe.”

Tetens said his staff has reviewed at least one other case involving Shaw that is pending in his office, adding it appears all procedures were properly followed in that case.

He said his office will not add Shaw to his office’s so-called “Brady List” based upon the results of the Sheriff’s Office internal investigation. Under Brady laws, prosecutors are required to inform defense attorneys of mitigating evidence and if they are aware of any ethical concerns about witnesses, including police officers, involved in the case.
