Judge revokes deferred probation for ex-Baylor frat president, finds him guilty of unlawful restraint and extends time on regular probation

WACO, Texas (KWTX) – A former Baylor University fraternity president who violated the terms of his probation on multiple occasions had his deferred probation revoked while being placed on regular probation for an additional six years.

Visiting Judge Roy Sparkman adjudicated Jacob Walter Anderson’s guilt on the unlawful restraint charge for which Anderson was placed on deferred probation for three years in 2018.

In a plea agreement with the McLennan County District Attorney’s Office, the judge placed Anderson on regular probation and extended his probation time on sex offender caseload by six years.

In deferred probation cases, there is no final judgment of guilt if the defendant successfully completes probation. In Anderson’s case, prosecutors asked Sparkman to find him guilty and revoke his probation. And while he faced up to 10 years in prison, McLennan County District Attorney Josh Tetens said he thinks justice was served best by extending Anderson’s probation, not sending him to prison.

“Based upon the originally pled offense of unlawful restraint, the time between the violations and our office’s knowledge of them, and upon the advice of our expert, we did not expect the court to give the maximum sentence of 10 years if we proceeded with a full revocation hearing,” Tetens said. “Instead, with this final conviction and extension of intensive sex offender probation requirements for six more years, we believe the safety of community is better served.”

Anderson, a Garland resident, was being supervised by the Dallas County probation department on a specialized sex offender caseload. His probation was extended by an additional three years after a number of violations, including accessing the internet to view sexually explicit materials, violating travel and curfew restrictions, illegal drug use and failing to avoid contact with children.

His internet privileges were revoked, and in February 2021, Anderson admitted “sexually deviant fantasies involving minors,” which resulted in amended orders for him to have no contact with minors and child safety zone restrictions were imposed.

That same month, Anderson’s sex offender treatment provider recommended his probation term be extended for a minimum of three years because “Mr. Anderson’s almost indiscriminate arousal to behaviors involving power/control, degradation and violence, reflect a person who would be a significant threat to the community, especially those with whom he has a relationship, if left unmonitored,” according to court records.

On Nov. 4, 2024, Anderson’s probation officer noted in a report that he disclosed to his therapist in 2021 that he “sexualized” a baby boy and touched him improperly while changing his diaper.

“He said he kept it a secret because, in his mind, that meant he molested him,” according to probation records. “He said he did not take it any further because he was on probation and was trying to do what he thought he ‘could get away with.’”

Anderson, 29, was charged with sexually assaulting a Baylor sophomore at an off-campus home known as the “Phi Delt Ranch” during a party in 2016. He pleaded no contest to the lesser charge of unlawful restraint and was placed on deferred probation for three years. Prosecutors agreed to dismiss four counts of sexual assault against Anderson in a plea bargain that sparked public outrage and spawned a petition drive signed by more than 85,000 people opposed to the plea agreement.

Baylor ousted Anderson from school and suspended the fraternity in the wake of the allegations. The victim reached undisclosed settlements with the fraternity and at least 17 fraternity members in a civil lawsuit.

At Anderson’s sentencing hearing in December 2018, the victim condemned the plea agreement. In an emotional victim impact statement, she described in graphic detail what she said Anderson did to her.

“When I was completely unconscious, he dumped me face down in the dirt and left me there to die,” the woman said. “He had taken what he wanted, had proven his power over my body. He then walked home and went to bed without a second thought to the ravaged, half-dead woman he had left behind.”

Tetens said Anderson’s case was handled initially by a previous administration.

“While we disagree with the initial punishment granted to Mr. Anderson in 2018, our team’s goal in reviewing his probation status was to prioritize protection of the community and to make the best use of the available legal options,” Tetens said in a statement. “To that end, our staff conducted a thorough investigation into the case, including reviewing case-specific facts in cooperation with probation officers in both Dallas and McLennan counties. Our team also consulted an expert licensed sex offender treatment provider to help determine the best course of action on Mr. Anderson’s case.

“Evidence established that Mr. Anderson had committed no probation violations in nearly four years. Because of that, our team determined that successfully securing a lengthy prison sentence was unlikely. If Mr. Anderson received only a short prison sentence for those old violations, he would likely return to the community in the near-future with far less supervision than that which he is currently under.”
