So, we requested the number of hours first our elected official was at work along with his side kicks! The Sheriff Department request an AG opinion STALL TACTIC from releasing said information again causing the taxpayers for every stall they do. Fast forward reworded the request to just the number of days the Sheriff and his employees were at work to which we were told (SEE THE AG OPINION LETTER TO RELEASE OR SHOULD I SAY TO STALL) that they information does not exist because they only swipe in…… All a dog and pony show so that the public does not know how much time the sheriff IS NOT AT WORK!! A complaint has been filed on McLennan County with the AG’s office that my friends is a two-way street. TRANSPARENCY people that is what keeps them honest. By the way not a word on the request for the Jail Logs…..

Dear Mr. Paxton:
On 10-23-2023, the McLennan County Sheriff’s Office received a public information request which seeks information regarding magnetic swipe logs into buildings on a number of McLennan County Sheriff’s Office Employees. A true and correct copy of the request is attached hereto as Exhibit “A”. The portion of the request labeled #4 has already been answered with the requestor. It is only the portion that is asking for the magnetic swipe logs that we have an issue with. We have electronic logs of the access cards/codes that are used to access our facilities. No other method of record keeping of physical presence or time spent at specific facilities is maintained by the Sheriff’s Office. However, I believe the responsive information is excepted from disclosure under Gov’t Code § 552.108(b)(1) and Gov’t Code § 552.101 (on the basis of Gov’t Code § 418.181). See below for specific reasons for why I believe the information is excepted from disclosure. Also, I’ve attached a couple of prior ruling letters from the AG’s Office that are similar to our current issue as Exhibit “C”.
The information, if released, would interfere with law enforcement because it reveals the schedule of the Sheriff and other employees of the department by demonstrating a pattern of their comings and goings from the department. If the information were made public, criminals and others could anticipate their arrivals and departures from the department, jeopardizing their and others’ safety.
· I assert that the information is excepted from disclosure under Gov’t Code § 552.108(b)(1).
Additionally, this information is confidential because it identifies technical details of particular vulnerabilities of critical infrastructure to an act of terrorism. The Sheriff’s Office falls under the definition of critical infrastructure provided in Gov’t Code § 421.001 (“all public or private assets, systems, and functions vital to the security, governance, public health and safety, economy, or morale of the state or the nation”). The responsive information indicates when the Sheriff and other employees enter and exit the Sheriff’s Office facilities. This information could be used as part of a plan to disrupt or cause harm to the individuals, as well as to the facilities and their occupants. The
information is useful to terrorists for identifying vulnerabilities of the building access point and would be useful in strategizing how and when to gain access to the facilities in order to inflict death and injury to persons through the use of explosives or biological agents.
· I assert that the information is confidential under Gov’t Code § 418.181, and thus is excepted from disclosure under Gov’t Code § 552.101
I am informing the Requestor of this request for an opinion by copy of this letter. Enclosed herewith as Exhibit “B” is a representative sample of the requested information for review. The requestor will be provided with the basic information and any other expressly public information not excepted. I respectfully request your opinion on this matter.
