When I left my brief 18-month professional sojourn in Waco & relocated out of state in June 1981, I vowed never to return due to Waco’s small town “bubba atmosphere” heavily influenced by Baylor University.
However, personal & professional circumstances unexpectedly brought me back 27 years later. The year was 2008.
In the intervening years I’ve seen Waco grow as a medium-size economic Texas powerhouse led by the tourism, hospitality & manufacturing industries. I even became part of the local hospitality sector with my own venue for almost seven years.
However, I discovered through years-long legal dealings with an unscrupulous local bank which had financed my business that the “bubba machine” was still intact and, for someone like me, unbeatable.
My Dallas attorney was amazed the local & Waco-based federal courts ruled against our efforts to defend ourselves against this bank. Thwarted at every turn, the courts denied our request for a jury trial no less than three times. Each request was met with a decision for a bench trial only. So our “day in court in front of our peers” never came to pass. I’m certain a jury would have found the merits of our defense against the bank whose own lending officer admitted in his deposition of committing fraud in the inducement regarding our construction loans.
I’ve often wondered since losing the business & our land in the process how much the good ol’ boy money machine network among judges, attorneys & litigants such as this major local bank is at play in Waco-McLennan County even today.
It’s very sad when the judicial system you’ve been taught to trust all your life turns out to be so much less than. Sadly my future in Waco may not be for much longer.
