Major drug case dismissed after McLennan County, Texas sheriff deputy’s sworn affidavit did not match evidence
Deputy placed on administrative leave pending internal investigation

WACO, Texas (KWTX) – The McLennan County District Attorney’s Office has dismissed a major drug case after discovering that a sheriff deputy’s sworn statement in a probable cause arrest affidavit contradicted the evidence.
Bryan Christopher Parr, 36, of Marlin, was set to stand trial Monday in Waco’s 19th State District Court on two counts of possession of a controlled substance with intent to deliver, first-degree felonies that carry a maximum life prison term.
However, as prosecutors Kristi DeCluitt and Chris Spendlove were preparing the case for trial, they discovered dashcam video from Deputy Derrick Shaw’s patrol car that did not match his sworn statement in arrest affidavits that he had probable cause to pull Parr over because of “defective equipment.”
Shaw did not return phone messages left for him Monday at the sheriff’s office. Sheriff Parnell McNamara did not return phone calls on Monday. Chief Deputy Cody Blossman said Shaw was placed on administrative leave with pay Monday pending an internal investigation.
In arrest reports and in dashcam recordings the night of July 19, 2024, Shaw reports that Parr’s license plate light was not working and that’s why he pulled him over in the 200 block of Hallsburg Road.
The video, which the prosecutors provided to defense attorney Bryan Cantrell, show the back of Parr’s car with the license plate light shining brightly along with other lights on the back of the car.

After searching the car, Shaw reported he found a black backpack in the back seat that contained 6.6 grams of methamphetamine, 36.7 grams of ecstasy, 7.6 grams of cocaine, 0.6 of a gram of crack cocaine, 11 THC vapes and six packages of THC gummies.
Cantrell also noticed the discrepancy and said he was prepared to offer into evidence a sales receipt showing Parr bought a new license plate light just days before Shaw pulled him over.
However, Cantrell said he didn’t have to spring that surprise at trial because DeCluitt and Spendlove did the right thing by dismissing the cases.
“It goes to their integrity,” Cantrell. “I didn’t have to tell them. Kristi came to me and said, ‘Look, I’m not putting a liar on the stand.’ Knowing Kristi and Chris the way I do, their integrity will not allow them to use an officer as a witness if they thought he had lied for an arrest. The integrity in that DA’s office is off the chart. They won’t put an officer like that on the stand. They really believe in the constitution and they really believe in doing things the right way, and they proved that to me again.”
County records show Parr was released from the McLennan County Jail Saturday after spending about seven months locked up.
“We don’t need police officers out there who are going to lie about stops, period,” Cantrell said. “We have way too many good cops in this county to allow even one bad cop.”
In notices filed Friday, DeCluitt wrote the cases were being dismissed for “lack of probable cause for traffic stop verified by dashcam video.”
District Attorney Josh Tetens said the cases were dropped “after a careful review of all the evidence provided.”
Tetens declined comment when asked if Shaw now will be added to the DA’s office so-called “Brady list.” Under Brady laws, prosecutors are required to inform defense attorneys of mitigating evidence and if they are aware of any ethical concerns about witnesses, including police officers, involved in the case.
