As usual no entity WANTS TO GIVE anyone the truth so you have to play a game, you ask them for the records, they know they’re supposed to give it to you BUT instead they go to Ken Paxton for an Opinion. This gives them time to try to get their shi* together. Same thing time after time, just a game to keep secrets.

of June 2022, I, ________, submitted an Open Record’s Request to the

McLennan County Sheriff’s Department requesting the release of dash camera video footage

involving a McLennan County Sheriff Deputy who struck and killed a pedestrian on IH-35 in

Waco, TX on 7 May 2022. It is now my understanding that the Texas Rangers have taken over

the investigation of this incident from the Waco Police Department. With that said and

pursuant to 552.108 (a)(1) and (b)(1) of the Texas Government Code, I understand that the

above information cannot be released during an active investigation. However, I would like to

reserve the right to receive a copy of the dash camera video upon conclusion of the

investigation.

Secondly, Ms. Lisa Foster mentions 552.101 of the Texas Government Code regarding

common law privacy and information of a highly intimate or embarrassing nature, such that its

release would be objectionable to a reasonable person, and it is of no legitimate concert to the

public. Ms. Foster goes on to make a statement which I MOST CERTAINLY DISAGREE WITH:

“The morbid curiosity of some random persons does not justify making the family re-live the

nightmare. There is no justifiable public interest in the release of this video”.

I’d like to first state that I DO NOT have any MORBID CURIOSITY in this video. I am simply an

independent journalist who would like to be responsible in that my reporting have ALL available

FACTS prior to publishing. It is important to me and my viewers to be accurate and for the

PEOPLE to know the TRUTH as to what happened on the early morning hours of May 7, 2022.

IF I am allowed to receive this video, everything will be done to preserve the privacy of the

deceased. I absolutely understand the graphic nature of what happened as I have been a

paramedic for more than 3 decades and will do everything in my power to preserve the dignity

of the deceased and the deceased’s family.

Any and all text messages and/or videos/photos regarding information on the above call on both county issued cellular phones as well as personal cellular phones.Government Code 552.004 PRESERVATION OF INFORMATION Senate Bill 944 amends the Government Code to ensure that public information on a privately-owned device (read: your personal cell phone, tablet, or computer: of a current of former officer or employee of a governmental body is transferred to the governmental body or appropriately preserved as required by 553.004(a). 5. All radio traffic regarding the response and ongoing communications to otherresponding emergency personnel to the above call.The acceptable format to receive the copy of responsive information is electronic format, such as native email format or PDF for documents and CD/DVD for audio/video. Since the release of this information primarily benefits the general public, I request a waiver of all fees. In the interest of f efficiency and transparency, I request release of all responsive information that “may” be withheld from public disclosure.
