There is a real argument against the assignment. HB 2715 says the regional presiding judge “shall assign a district court judge” from a district outside the filing county. Waldrip is both the regional presiding judge and the judge of the 433rd District Court in Comal County. The outside-county requirement appears satisfied, but the statute does not expressly say whether the presiding judge may choose himself. I cannot honestly tell you that self-assignment is plainly forbidden by its text. That is a question worth raising and getting a ruling on.
